Terms of Use (End User License Agreement)

Welcome to Flare. Please read these Terms carefully before using the app.
Introduction
These Terms of Use and End User License Agreement ("Terms") govern your use of the Flare mobile application, website, and related services (collectively, the "Service"). By downloading, installing, creating an account on, or using Flare, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility
Flare is intended for individuals who are 18 years of age or older. By using the Service, you represent and warrant that:
- You are at least 18 years old;
- You have the legal capacity to enter into a binding agreement; and
- You will comply with these Terms and all applicable laws.
If you do not meet these requirements, you may not access or use the Service.
2. License to Use the Service (EULA)
Subject to your continued compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and install the Flare app on devices that you own or control and to access and use the Service for your personal, non-commercial use only.
You agree that you will not:
- Copy, modify, adapt, translate, or create derivative works based on the Service;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app, except where permitted by law;
- Sell, resell, rent, lease, sublicense, distribute, or commercially exploit the Service; or
- Bypass, interfere with, or disable any security or technical features of the Service.
All rights not expressly granted to you under these Terms are reserved by Flare and its licensors.
3. Your Account
To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration, maintain and promptly update your information as needed, keep your login credentials confidential, and be responsible for all activity that occurs under your account.
We may suspend or terminate your account if we reasonably believe you have violated these Terms or our community guidelines, engaged in fraud, abuse, or harmful behavior, or misused or attempted to misuse the Service.
4. Subscriptions and Payments
Flare may offer premium features or content through subscriptions or in-app purchases via the Apple App Store, Google Play Store, or other authorized platforms. Pricing, subscription periods, and any free trial details are displayed in-app before you confirm a purchase.
Payments and billing are processed by the applicable app store under its own terms and refund policies. Unless otherwise stated, subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage or cancel your subscription in your device’s account settings for the relevant app store. Flare does not process payments directly and cannot override or guarantee refunds beyond those provided by the app stores.
5. User Content and MBTI Features
The Service allows you to upload and share videos ("Flares"), text posts, messages, and other materials ("User Content"). Flare also includes features such as AI MBTI Guessing, MBTI Cards, and the GuessMe forum, where you interact with other users.
You retain ownership of your User Content. By submitting or posting User Content on or through the Service, you grant Flare a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, display, reproduce, modify (for formatting and display), and distribute your content solely for the purpose of operating, improving, and promoting the Service.
You are solely responsible for your User Content and for ensuring that you have all rights necessary to post it. You agree not to post, upload, or share User Content that contains hate speech, harassment, threats, or encouragement of self-harm or violence; contains nudity, explicit content, or otherwise inappropriate material; is misleading, fraudulent, or impersonates any person or entity; infringes any copyright, trademark, privacy, or other rights of any third party; or violates any applicable law or regulation. We reserve the right to review, remove, or moderate User Content that we believe violates these Terms, our policies, or applicable law, or that may pose a risk to users or the platform.
6. Safety and Acceptable Use
Flare is designed to support authentic, respectful social interactions. You agree that you will not harass, stalk, threaten, or harm other users; collect, store, or share personal data of other users without their clear consent; use the Service for spam, scams, or misleading schemes; attempt to gain unauthorized access to any accounts, systems, or networks; or use bots, scripts, or automated tools to access or interact with the Service unless expressly permitted. We encourage you to use the in-app tools to report or block users or content that violates these rules.
7. Intellectual Property
All rights, title, and interest in and to the Service (excluding User Content), including but not limited to software, designs, logos, trademarks, text, graphics, and other materials, are owned by Flare or its licensors and are protected by intellectual property laws. You may not use Flare’s name, logo, or trademarks without our prior written consent. Nothing in these Terms grants you any ownership rights in the Service.
8. Third-Party Services
The Service may integrate with or link to third-party services, websites, or content, including app stores and analytics tools. We do not control and are not responsible for third-party services. Your use of such services is subject to their own terms and privacy policies.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free; that it will be compatible with all devices or configurations; or that any information or content, including AI MBTI guesses, will be accurate, reliable, or suitable for any particular purpose. The AI and MBTI-related features are for entertainment and general informational purposes only and should not be treated as professional, psychological, or medical advice.
10. Limitation of Liability
To the maximum extent permitted by law, Flare and its officers, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages; loss of profits, data, goodwill, or other intangible losses arising out of or in connection with your use of, or inability to use, the Service. To the extent liability cannot be excluded, our total aggregate liability to you for all claims arising out of or related to the Service shall not exceed the amount you paid (if any) for access to the Service in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
11. Termination
You may stop using the Service and delete your account at any time through the app. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe that you violated these Terms or our policies, engaged in unlawful, harmful, or abusive behavior, or misused the Service or its features. Upon termination, your license to use the Service ends immediately. We may retain certain information as required by law, for legitimate business purposes, or for safety and moderation, such as to prevent abuse.
12. Changes to the Service and Terms
We may update, modify, or discontinue parts of the Service at any time. We may also update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. If changes are material, we may provide additional notice within the app. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved by the competent courts located in Seoul, South Korea, unless applicable law requires a different forum.
